The name 'Open Learning Academy' and the domain names openlearningacademy.co.uk, openlearningacademy.com, openlearningacademy.net and oplac.co.uk are the property of the Open Learning Academy. These marks may not be used in any way without the prior written permission of the Open Learning Academy.

Using the website and course materials
Open Learning Academy materials and any materials licensed from third parties are limited to non-commercial, personal use. No material may be copied, reproduced, re-published, uploaded, posted, transmitted or distributed in any way. Any such use constitutes an infringement of copyright and other intellectual property rights.
The website must not be used to transmit any material which may damage, or allow unauthorised access to, the website.

Identity codes and passwords
All registered users (students, tutors, schools or other learning centres) are issued with an identity code and password. Registered users are entirely responsible for the confidentiality of their password and accept all responsibility for any activity that takes place under this password.
Registered users also agree to accept responsibility for any expense, loss or damage incurred as a result of any misuse of their password.
Registered users are required to notify the Open Learning Academy immediately, if they believe that anyone other than themselves has used their password. In such circumstances users will be issued with a new password.

Privacy policy
The Open Learning Academy has been registered in accordance with the Data Protection Act. We are committed to respecting your privacy and protecting any information provided by you.
The information requested during registration is collected by the Open Learning Academy alone and is used to facilitate effective, personalised communication between student and tutor and to allow the Open Learning Academy to maintain contact with its registered users.
By supplying us with personal information, registered users agree to the collection and storage of this information and to the ongoing collection and storage of information relating to student progress.
Information within a student's progress record can be accessed only by the student, the student's tutor, the student's school or learning centre (if applicable) and the administration department of the Open Learning Academy.
Other than for the distribution of course materials, or if the law requires it, the Open Learning Academy will not disclose any personally identifiable information except when we have asked for, and been given, permission.
Registered students and tutors may, at any time, view the personal information held about them on the Open Learning Academy database by using their ID and password to access their personal records. They may update or correct this information by contacting admin@openlearningacademy.co.uk.
Through its password system, the Open Learning Academy endeavours to protect the information provided by its registered users, however users should be aware that transmission over the internet and the world wide web cannot be guaranteed as totally secure.
Please be aware that websites that have links on our site are not covered by this privacy statement.

Communication system (the system by which e-mails, assignments, queries, registration forms, tutor application forms, comments etc are sent and received) 
Whilst every effort is made to ensure that our communication system is free from defect, the Open Learning Academy does not accept responsibility for any damage to, or loss of data on, your computer system, network or server that results from the use of any of our materials or those licensed from any third parties.
Any advice or guidance given by the Open Learning Academy relating to any aspect of the communication system or its use is followed at the user's own risk.

Sending materials via the website
All communication between tutor and student must take place via the website.
Users should make a copy of all materials sent via the website, as the Open Learning Academy accepts no responsibility for the loss of any such material. 

Use of materials sent via the website
The Frequently-Asked Questions area of the website is made up of questions posed by students and answers supplied by tutors. The Web Links area is based on suggestions made by registered users. Comments sent to us may be used in the promotion of our services. We therefore require that registered users grant the Open Learning Academy the royalty free right and licence to reproduce, edit and display any materials sent by them via the website.

Availability
The Open Learning Academy endeavours to ensure that the website is available 24 hours a day, 7 days of the week. However, from time to time it may be necessary to interrupt the service for maintenance, upgrades or emergency repairs. 
The Open Learning Academy cannot be held responsible for any disruptions that are inherent in the operation of the internet or the world wide web (including viruses) which are beyond its control.

Responsibilities
When a course is purchased, the Open Learning Academy agrees to provide the following goods and services: 
* course materials which we believe are suitable for their purpose
* personal tuition in the form of responses to tutor-marked assignments (TMAs) and answers to queries relating to lessons in the course materials.
This is the extent of the Open Learning Academy's responsibility.

Limitations
The purchase of a course does not imply any guarantee of exam success, entrance to university or any other educational establishment, professional advancement or any other particular result. 
Tutors' comments and marks are offered in good faith but cannot be taken as a prediction of examination grades. 
The Open Learning Academy cannot and does not accept responsibility for entering students for exams or for ensuring that any coursework required is completed and/or assessed.

Acceptance of Students
Students under the age of 16 years can be considered for registration provided they have had a good, general education up to at least GCSE standard and will have the additional support and guidance of an adult at home or at school.
The Open Learning Academy reserves the right to decline the application of any student, regardless of age. 
Students are accepted on courses on the understanding that are they agreeing to abide by the Open Learning Academy's Terms and Conditions. Customers purchasing courses for use by someone other than themselves are responsible for ensuring the student is aware of, understands, and abides by these Terms and Conditions. 
It is the responsibility of course purchasers to satisfy themselves that courses are appropriate to their/the student's needs.

Course Duration
Students are expected to complete an AS or A2 course within a year and a full A level course within two years. However, should students find that they are unable to complete the course within this time limit and provided they contact the Open Learning Academy to request an extension, tutor support will be made available for up to two years for an AS or A2 course and up to three years for a full A level course. In such circumstances it will be the responsibility of the student to ensure that they make themselves aware of any changes to the syllabus and/or exam structure. 

Refunds
Should students or learning centres decide that the course materials do not meet their needs, they have 21 days in which to return them.
Returns should be sent to Oxford Open Learning, 4 King's Meadow, Oxford OX2 0DP.
If the materials are returned in good condition within 21 days, the course fee will be refunded and the student's identity code and password will be expired. 
If the materials are not returned within 21 days, it will be assumed that the materials are deemed suitable for their purpose.
After 21 days, refunds will only be considered if we fail to mark tutor-marked assignments or answer queries that have been submitted.

Termination
If you fail to comply with any of these Terms and Conditions, the Open Learning Academy may expire your identity code and password and you will no longer be able to access the registered user areas of the website. You will be required to return your course materials to the Open Learning Academy.
We reserve the right to expire your identity code and password and remove your details from our system if you have made no contact with the Open Learning Academy for 12 months or longer and have not responded to requests for information sent to the e-mail address we have on record for you.

Jurisdiction
This agreement shall be governed and interpreted in all respects in accordance with the Laws of England.
